JR Planning have recently secured planning permission for our client, Poplar Developments Ltd, following an appeal to the Planning Inspectorate. We were also able to secure a partial award of costs against the Council.

The proposals, which were designed by Brightman Clarke Architects, comprise 13 dwellings outside of the settlement limits for Lower Pilsley and were initially refused by the Council who cited fears regarding visual impact.

Working with and coordinating a team of specialists, we prepared a detailed appeal statement and subsequent rebuttal of the Council’s case. Our statements focussed on relevant case law, recent court decisions and similar cases in the area to ensure we had a robust case.

The appeal was successful with the Inspector concluding: ” I do not consider that the adverse impacts of allowing this appeal would significantly and demonstrably outweigh the benefits when assessed against the Framework as a whole. Consequently, I find that there are material considerations which indicate that the proposal should be determined otherwise than in accordance with the development plan.”
